Underage Drinking

For some people, underage drinking is simply a part of growing up or a rite of passage as adolescents move from childhood to adulthood. However, underage drinking is a serious problem that carries severe consequences.

As a former prosecutor in Hunterdon County, Anthony Kearns is fully familiar with police practices as is Victor Rotolo, a former police officer in Elizabeth, NJ. As experienced criminal attorneys, they are advocates for you in the court room.

In New Jersey, a person must be at least 21-years-old to legally buy, possess or drink alcohol. Drinking before the age of 21 carries penalties not only for the young person, but also for any adult who may have provided alcohol to them.

Penalties for an underage drinker in the State of New Jersey include a possible fine of $500 and loss of a driver license for six months. For those who do not yet have a driver license, the suspension would begin once they are eligible to get their license. Enrollment in a treatment or alcohol education program may also be mandated for the underage drinker.

Drivers under the age of 21 who are caught under the influence of alcohol can lose their license for a period of 30 to 90 days, be required to perform community service for 15 to 30 days, and to enroll in a traffic safety and/or alcohol education program.

Adults who purchase alcohol for underage drinkers or who allow underage drinking on their property could find themselves facing lawsuits and possible criminal prosecution, especially if someone is killed or injured as a result of the underage drinking.

Some parents may think of underage drinking as inevitable and may feel that by allowing their children and their children’s friends to drink at home, they are helping to keep them safe. The consequences for all parties, however, are severe.

Underage drinking is a crime, not a right. Because of this, it is important for you to seek the services of an experienced criminal attorney if you or your child are facing charges. If your child has been accused of underage drinking or if you have been accused of enabling underage drinking, call Kearns Rotolo Law. Protect your rights and your children’s rights. I am an attorney and have practiced law for 26 years. I hired Vic to handle a very difficult family matter because I do not handle family law. Vic was extremely competent and obtained a result far beyond my expectations. Without his counsel my son's and family's life would have been changed forever. Thank you Vic for your good lawyering. I very much appreciate the personal attention and time dedicated to this matter. I highly recommend Vic.

We recently had a situation where we needed to hire an attorney. We selected Kearns Rotolo Law and I can honestly say that we were above and beyond satisfied with Vic and his team. We would absolutely recommend this firm to anyone should the need arise. We blindly picked the firm out of the phone book because I liked his ad. Now I believe that God was pointing us in the right direction. Thank you Vic and Kearns Rotolo Law for being there for us in our time of need.

Victor's expertise, due diligence, and empathy for his client made my first experience with the law (and last) a non-stressful one. Before the case, I did my research and looked over about 20 lawyers before choosing Victor. All my sources pointed to him as the best and they weren't off even a bit. Victor treated my case like it was his own and kept me up to date with all my appointments, breakthroughs in the case, and guided me step through step in a process that I never thought that I had to come to endure. If Victor's not available Susy will go out of her way to take care you. The productivity and efficiency in that office is second to none. Thank you Victor!
