October 2020 - Two Important Questions to Ask a Personal Injury Lawyer

You should never file a personal injury lawsuit or settle your claim with an insurance company without first consulting an experienced attorney. Here are two important questions that may help you choose the right attorney:

1). Are you a Certified Civil Trial Attorney?

“Certified civil trial attorney” is a designation granted by the New Jersey Supreme Court to attorneys who demonstrate sufficient levels of experience, education, knowledge, and skill in trial practice. Only attorneys certified* by the New Jersey Supreme Court are entitled to use the designation “Certified by the Supreme Court of New Jersey as a Civil Trial Attorney” after having met the following criteria as set by the Board on Attorney Certification:

  • been a member in good standing with the NJ Bar for at least 5 years,
  • fulfilled ongoing continuing legal education requirements,
  • demonstrated substantial involvement in preparation of litigated matters,
  • demonstrated an unblemished reputation among other attorneys and judges familiar with their work, and
  • passed a written exam in civil trial law.

*According to the most recent available statistics, only about 2% of active New Jersey attorneys are certified.

2). Have You Handled Similar Cases and What is Your Success Rate at Trial?

The more successful case outcomes a lawyer has, the better it is for the client. Insurance companies who defend personal injury cases know the lawyers in your area who go into court to successfully try cases and those who do not, and they use that information to evaluate their risk. A successful personal injury attorney will prepare every case for a jury trial.
